Do not cite anything from FAR subpart 52.2 or DFARS subpart 252.2 – the prescription for provisions and clauses are ALWAYS found in the main parts of the FAR or DFARS. For example, the clause at 52.203-7 Anti-Kickback Procedures starts with the prescription which reads: “As prescribed in 3.502-3 , insert the following clause:” – you would then navigate to FAR 3.502-3 to determine if that guidance is relevant to your acquisition. The scenario has some italicized hints for you as you work through this assignment for things to watch for. Scenario: You have received a requirement for 10 noncommercial shark-mounted laser weapon systems that is expected to cost $1,500,000. The items must be delivered to Guam. The acquisition will be conducted full and open competition (i.e., it will not be set aside for small business), and subcontracting possibilities DO exist. You intend to use negotiated contracting procedures and award a cost-plus-incentive-fee contract without conducting discussions. The Government is willing to accept alternate proposals. Due to budget constraints, the contract will be incrementally funded. The DoD requires form, fit, and function data rights. None of the exceptions at FAR 27.409(b)(1) apply. There will be no Government property provided, and this acquisition is not in support of a declared contingency operation. The solicitation contains all provisions and clauses required by the FAR and DFARS, except for those shown below – your task is to determine if the identified provision or clause SHOULD be included.
