Why do the dissenting judges believe it is so important here?

The dissenting opinion here speaks significantly about separation of powers. Why do the dissenting judges believe it is so important here? Also, take a look at the video link BELOW. Do you agree with Supreme Court Justice Scalia (who died this year) who is essentially saying “garbage-in-garbage-out” with regard to the laws that judges have to interpret and apply.
